this is ebays resopnse rember they spout all that BS about legaly binding cotracts
Hi Gavin,

Thanks for contacting eBay regarding your seller who was not willing to
sell you the item even if you were the winning bidder. I'm sorry that
you've had such inconvenience with this transaction. Just like you, we
are extremely concern about selling violations and members who take away
from the integrity of an auction. I’ll be willing to help you with
this.

Gavin, please be assured that we will conduct thorough investigation on
the seller’s account. We take your report seriously and we won't
tolerate members with such inappropriate behavior and take action when
necessary. Our actions may include listing cancellation, limits on
account privileges, account suspension, forfeit of eBay fees on
cancelled listings and loss of PowerSeller status. However, for privacy
reasons, I cannot discuss the action that we will take. I hope this
gives you assurance that your account information will also remain
private.

Since the item is with the seller, we at eBay cannot force them to
complete the sale or send the item. Though eBay is an online venue where
people can buy and sell items, we do not have the items, nor do payments
ever pass through our hands. We do, however, have policies and sanctions
that we enforce whenever members commit an action that is not in line
with our guidelines. That is why, with your report, I was able to
quickly take action on the sellers account.

I'd also encourage you to leave Feedback for signal1234. As the buyer,
you have the power to leave appropriate Feedback and Detailed Seller
Ratings for your trading partner to signify how satisfied or
dissatisfied you are with the whole situation. Let me assure you that
appropriate Feedback will create a huge impact on his account since this
will be visible to the community. DSR's will also impact their account
since we restrict sellers from selling once their DSR ratings go below
our set standards, and the fee discounts are revoked.

We expect seller to deliver a high level of satisfaction to their
customers. When a buyer wins an item on eBay, the seller and buyer have
entered a contract that both members are expected to honor. It is a
seller's obligation to send the item that was described in the listing
and provide good service. Sellers who don't fulfill their obligations
will be in breach of their contract.

Gavin, I am confident that I've put you at ease. You've been a valuable
member of the eBay community since September 2005. I trust that all of
your future endeavours with us are not only pleasant, but successful as
well. Have a good day ahead of you.

Warm Regards,

Hilda P.
Trust and Safety Team

Cheers Gav

Unfortunate. When I see a ebay auction listing a car or big dollar item, I don't even bother bidding if feedback is zero.

If it sounds too good to be true, it usually is.

Time to leave a really long NASTY factual feedback report, the longer the better that way when others see the looong report they won't bother reading all of it and simply bypass them, works well

Actually it doesn't because ebay sets a limit on the length of feedback which ends up only being 1-2 lines if you're lucky.
